These Terms of Sale set out the basis on which you may purchase pieces from our website at www.selinamurray.com. Please read them carefully before placing an order. We are committed to offering a considered, personal service and to ensuring that your rights when purchasing from us are clearly understood.

Purchase terms for products

We take great care in creating jewellery of exceptional quality. The product description on each product page sets out the individual details and specifications of the piece. While we take reasonable care to ensure that product descriptions, imagery and prices are accurate, information on the website may not always reflect availability at the exact moment an order is placed.

Product images on our website are provided for illustration. We make every reasonable effort to present each piece as accurately as possible, but we cannot guarantee that the images shown on your device will reflect the exact appearance of the product. Packaging may also vary from that shown.

Please note that colours may appear differently across screens and devices, and we therefore cannot guarantee that colour will be displayed exactly as it appears in person.

You may only purchase products through our website if you are aged 18 or over, are legally able to enter into a binding contract and are buying as a consumer. If you are enquiring on behalf of a business, please contact us to discuss your requirements.

Pricing and Descriptions

The details and specifications for each piece are set out in the relevant product description. We recommend reading these carefully before placing your order, as each piece may have its own individual characteristics.

Prices for each piece are shown on the website. The total amount payable, including any applicable taxes, will be displayed at checkout. Delivery charges are separate from the product price and, where applicable, will be added during checkout.

We reserve the right to amend our prices at any time, although any such change will not affect an order for which an order confirmation email has already been issued.

 Although we take great care with pricing, a product may occasionally be listed incorrectly. If the correct price is lower than the price shown, we will charge the lower amount. If the correct price is higher, we will contact you before accepting the order and give you the option to proceed at the correct price or cancel. If we are unable to reach you using the contact details provided, we may treat the order as cancelled and notify you in writing. We are not obliged to supply a product at an incorrect price where the error is obvious and could reasonably have been recognised as a pricing mistake.

We take reasonable care to ensure that product details, descriptions and prices on our website are accurate when published. However, from time to time there may be minor errors or information that has not yet been updated. We do not guarantee that all information on the website is complete, accurate or current at every moment. The price of a product will only be confirmed once we accept your order in accordance with these terms.

Placing an Order

By placing an order with us, you confirm that you have read and accepted these Terms of Sale. If you have any questions before ordering, please contact us at hello@selinamurray.com.

When you place an order, we will ask for the information required to process it, including your name, email address, billing and delivery address, telephone number and payment details. We use this information to fulfil your order and to contact you if there is an issue relating to it.

Once you have selected a piece and placed your order, you will receive an order confirmation email. This email acknowledges receipt of your order but does not constitute acceptance. All orders are subject to acceptance by us. A contract between you and us will only be formed once we have accepted, processed and dispatched your order.

If we are unable to fulfil your order, we will let you know as soon as possible. If payment has already been taken, we will issue a refund.

E-Gift Cards

The following terms apply to the redemption of e-gift cards:

·      E-Gift cards expire 12 months from the date of which they have been purchased.

·      The balance on a e-gift card can be spent on more than one order, as long as there is still a balance on the e-gift card.

·      E-Gift card balances are applied to the total value of an order, which can include taxes and shipping.

·      E-Gift cards can be used together with discount codes.

·      Multiple e-gift cards can be used on a single order.

·      An e-gift card cannot be used to buy another e-gift card.

Checking Your E-Gift Card Balance

To check the balance of your e-gift card, please email hello@selinamurray.com with your name and e-gift card code.

Cancellations

If you are purchasing as a consumer online, you have the legal right to cancel your order with us, subject to the limitations set out below. This right begins on the date you place your order and ends 14 calendar days after the day you receive the product.

Unless you are ordering bespoke or made-to-order goods, you do not need to give a reason for cancelling. To cancel your order, please email hello@selinamurray.com and include your order number. We will confirm receipt of your cancellation by email.

Please note that, in accordance with the Consumer Contracts Regulations 2013, we cannot accept returns of items that have been personalised, bespoke or custom-made to your specification.

Where you are entitled to cancel and have already received the product, you must return it to us at your own cost in its original condition and packaging, together with any additional packaging used for the return. We may reduce the amount of any refund to reflect any loss in value caused by handling beyond what is reasonably necessary to inspect the item. Once we receive the returned product, we will arrange a refund to the payment method used for the order. Please allow up to 14 days for the refund to appear on your bank statement. We will refund the price paid for the product and the original delivery charge, but not the cost of returning the item to us.

You must return the product within 14 days of your cancellation being confirmed. Due to the value of the goods, we will confirm the returns address by email.

If you cancel before your order has been dispatched, we will process your refund within 14 days of cancellation.

If you cancel only part of your order, delivery charges will not be refunded.

Bespoke and Personalised Pieces

As permitted by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, we are unable to offer refunds for items that have been personalised, bespoke or custom-made to your specification.

We love sharing our creations on our website and social media. Photos and/or videos of your jewellery may be used for marketing purposes. We will never share your personal details. If you would prefer your order not to be featured, please let us know when placing your order.

Faults and Repairs

If you believe a product is faulty or not as described, please email hello@selinamurray.com with your order number, a description of the issue and photographs showing the fault or damage. A product will be treated as faulty if it arrives damaged or if a manufacturing fault becomes apparent within 30 days of purchase. This does not include normal wear and tear.

If we ask you to return a product that you believe is faulty, we will confirm the returns address by email.

All items returned as potentially faulty will be inspected once received. We will then contact you by email to confirm whether you are entitled to a repair, replacement or refund. Where appropriate, we will usually offer a like-for-like replacement first. If a refund is due, it will be made within 30 days of our confirmation. Where you are entitled to a refund because a product is faulty, we will refund the price paid, the original delivery charge and the reasonable cost of returning the item to us

Delivery

Unless you are purchasing a pre-order item or a bespoke piece, in which case an estimated delivery date will be provided, delivery will usually take place within 2 to 3 weeks for sterling silver and 9ct gold pieces, and within 4 to 6 weeks for 18ct gold pieces, from the date of your order confirmation.

Orders are typically sent by Royal Mail Special Delivery, tracked and signed for, and a signature will be required on delivery. Orders with a value over £500 are sent free of charge.

If we do not deliver your order within the timescales set out above, or within any other period agreed with you, you may contact us to cancel your order.

We are not responsible for delays outside our reasonable control e.g., industrial action, fuel shortages, utility failures, severe weather, war, conflict, customs delays, courier disruption etc.  However, we will let you know as soon as possible if a delay affects your order and will take reasonable steps to minimise its impact where possible.

If you give us delivery instructions, including instructions to leave the parcel in a particular place or with a neighbour, you are responsible for making sure those instructions are accurate. We will not be liable for any loss of or damage to the product resulting from us following those instructions. Delivery is complete when the product is delivered to the address you provided, or in accordance with your instructions.

Returns and Exchanges

We accept returns of Ready to Ship pieces within 14 days of receipt, provided the item is unworn and returned in its original condition and packaging.

Please contact us by email to arrange a return.

We cannot accept returns or offer refunds for personalised, bespoke or custom-made items created to your specification.

For hygiene reasons, pierced earrings cannot be returned.

If a return is sent from outside the UK, it must be clearly marked on the customs paperwork as a returned UK order. If import duties or taxes are charged to us because the customs documentation is incomplete or incorrect, we may deduct those amounts from your refund. 

International Orders

We deliver to selected destinations outside the UK. If you would like to confirm whether we can ship to your location, please contact us by email before placing your order.

International orders are shipped from England on a Delivery Duty Unpaid (DDU) basis. As the recipient, you are considered the importer and must comply with all local laws and regulations. You may be subject to import duties, taxes, and handling fees. These charges are not included in the price of the products or shipping costs and are the sole responsibility of the customer. Selina Murray Ltd is not responsible for any delays caused by the customs clearance process. We recommend checking with your local customs office before placing an order. We cannot accept returns or provide refunds, replacements or credit notes where the recipient refuses delivery or refuses to pay customs charges.

Delays Beyond Our Control

Normal delivery period may be longer if due to events beyond the control of Selina Murray Jewellery e.g., industrial action, fuel shortages, utility failures, severe weather, war, conflict, customs delays, courier disruption.

Warranty and Liability

We warrant that any product purchased from us will, for a period of 12 months from the date of delivery, be of satisfactory quality, free from material defects and reasonably fit for the purposes for which products of that kind are commonly supplied.

This warranty does not apply to defects caused by fair wear and tear, failure to follow any care instructions, wilful damage, abnormal storage, accident, negligence by you or a third party, or any alteration or repair carried out by you or a third party.

Our liability for any loss you suffer as a result of our breach of these terms is limited to the price paid for the product and any losses that are a foreseeable result of that breach. A loss is foreseeable if it is an obvious consequence of our breach or if it was contemplated by both you and us at the time of purchase.

We do not exclude or limit in any way our liability:

  • For death or personal injury caused by our negligence;
  • Under section 2(3) of the Consumer Protection Act 1987;
  • For breach of the terms implied by sections 12 to 15 of the Sale of Goods Act 1979;
  • For fraud or fraudulent misrepresentation; or
  • For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

We supply our products for domestic and private use only. You agree not to use them for commercial, business or resale purposes, and we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

Law and Jurisdiction

We are based in the United Kingdom and these Terms of Sale are governed by English law. Any claim or dispute arising from a purchase made through our website will be subject to the exclusive jurisdiction of the courts of England.
